Barrett & Farahany is investigating a lawsuit regarding unpaid overtime wages for outside sales representatives against Amerisave.  Barrett & Farahany has filed a lawsuit against Amerisave on behalf of SMP's.

The Plaintiffs have alleged that Amerisave pays its 'outside sales representatives' on a straight commission basis and Plaintiffs allege that Amerisave does not pay its employees the appropriate overtime or minimum wage.  The investigation is to determine whether "Outside sales" representatives work primarily out of their home and do not visit their customer's place of business.

The lawsuit against the SMP or "Inside sales representatives" allege that SMP's are paid on a minimum wage plus commission basis and the Plaintiffs allege that SMP's are not paid all of their overtime or overtime on their commissions.
