After a local Bucks County Police officer or a Pennsylvania State Police officer determines that there is probable cause that you are drinking and driving, he or she will arrest you.

You will then be placed in “custody” when you are either put in hand cuffs, put into the back of the police vehicle, or detained in the police station. While in custody, if the police officer asks you questions about the incident, you have the right to remain silent.

Usually at this point, you will be taken to the closest local hospital for a blood alcohol test or to the police station for a breath test. After the testing procedure, you may be taken to the police station for “processing”.   Processing consists of the police officer inputting your data into the police computer system, taking your photograph, and fingerprinting.

If you are lucky, the police officer may then drive you home, if you live locally. Otherwise, you will need to have someone pick you up at the police station.

Unfortunately, from the point of arrest until the time you are released, you are not permitted to be counseled by a lawyer.   If you are not processed after you are arrested, you will then need to be processed after the Bucks County Preliminary Hearing.
